1. Purpose

These General Terms and Conditions of Sale (hereinafter "GTC") govern the sales of personalized products offered by brode personnalise (hereinafter "the Seller"), whether in physical store or on the website brodepersonnalise.fr.
They define the rights and obligations of the parties in the context of the sale of personalized items.

2. Products

The products sold are personalized textile items and accessories for babies, children and adults.
Each item is made and/or personalized at the customer's request, according to the options chosen (first name, color, font, etc.).
The photos and visuals shown are not contractual; slight variations may exist depending on the lighting, the color of the fabric or the rendering of the embroidery.

3. Orders

All orders are firm and final upon validation of payment.
In the case of personalization, the customer is responsible for the accuracy of the information provided (spelling of the first name, choice of colours, etc.).
No changes can be made after validation, except with the express agreement of the Seller.

4. Prices

Prices are expressed in euros, including all taxes (TTC).
The Seller reserves the right to modify its prices at any time, while guaranteeing the customer the application of the price displayed at the time of the order.

5. Payment

Payment is due upon ordering, by credit card, PayPal, or any other method offered by the Seller.
The order is only processed after full payment has been received.

6. Timeframes and delivery

  • In store : collection possible on the date indicated when ordering.

  • Online : shipping within 6 business days after payment confirmation and personalization.
    The delivery times are given as a guide and may vary in the event of high demand or exceptional circumstances.
    Delivery costs are the responsibility of the customer, unless otherwise stated.

7. Right of withdrawal

In accordance with Article L221-28 of the Consumer Code , the right of withdrawal does not apply to personalized or made-to-order products.
No returns, exchanges or refunds are possible for these items, except in the case of a proven defect attributable to the Seller.

8. Warranty and Claims

In the event of a defective product or a product that does not conform to the order, the customer must inform the Seller in writing (email contact@brodepersonnalise.fr) within 48 hours of receipt, with supporting photos.
If the defect is confirmed, a replacement or a credit note will be offered.
Damage resulting from misuse or improper maintenance is not covered.

9. Responsibility

The Seller shall not be held responsible for any delay in delivery due to force majeure, an error in the address provided by the customer, or a problem attributable to the carrier.

10. Intellectual Property

The creations, photos, texts and models present on the site or in store are the exclusive property of Brode Personnalise.
Any reproduction or use without written permission is prohibited.

11. Protection of personal data

The information collected is necessary for order management and is not transmitted to third parties, except to delivery providers.
In accordance with the "Data Protection Act", the customer has the right to access, rectify and delete their data.

12. Applicable Law and Disputes

These Terms and Conditions are governed by French law.
In the event of a dispute, and after attempting to resolve it amicably, jurisdiction is granted to the competent courts of Lille, unless otherwise stipulated.
